Following the trustees doubts as regards the proper objects of the Charity, Counsel's Opinion was obtained on the subject. Opinion was obtained from: Mr Mansfield [1794]; Mr Bearcroft [1794]; Mr Beatniffe [1792]; Mr Osborne [1789 & 1794] and Mr Fonblanque [1796]. Counsel advised that the clause in the will relating to the Testatrix's relations only applied to those relatives that were living at her death and that it should not be applied ad infinitum.

In view of this, an information was filed in the Court of Chancery by the Vicars of Holy Trinity, Sutton and Hedon against the Churchwardens of the Parish of Sutton who, it was claimed, had been preventing widows or daughters of clergymen from entering the College or Almhouse in favour of the Testatrix's relatives.
