The Revd Michael Brumskill, Vicar of the Parish of Sutton, the Revd Jonathan Butt Rector of the Parish of Hedon and the Revd Jonathan Healey Bromby Vicar of the Parish of Holy Trinity the informants, brought a case against William Capes and George Rea Churchwardens of the Parish of Sutton, defendents.

The informants claim that children and grand children of Mrs Watson are still claiming the right to settle in the college and use of the charities in Stoneferry under the terms of her will and that once admitted they do not pay proper regard to reading of prayers in the hospital or attending service at church. They claim that this is resulting in widows and daughters of clergymen never being admitted. In view of this the informants have taken the opinion of three eminent counsels all of whom agree that the claims of kin should no longer be relevant. The Churchwardens had since put locks on vacant rooms to ensure widows and daughters could not be admitted.

The Trustees were obliged to file an Information in the name of the Attorney General against the Churchwardens of Sutton and ask the Lord Chancellor for advice.
