Description:

The court case was heard in the High Court of Justice Chancery Division in 1924-1925. The plaintiffs were Sir Robert Charles Ochiltrie Stuart, Claude George Cole Hamilton, William Henry Todd and William Todd, the trustees of Sophia Barnard's will, and the defendants were Ursula Mary Florence Barnard, Joseph Henry Delpratt (and his executors after his death in 1924) and Legal and General Assurance Society Limited. The case sought to clarify elements of Sophia Barnard's will, particularly in respect of whether the trustees required Ursula Barnard's consent to dispose of property, as the trustees wished to let or sell Cave Castle and sell many of its contents. The house had been unoccupied for some time and was beginning to fall into disrepair. In April 1925 an order was made granting the trustees' request.

This series also contains several documents relating to an earlier case to appoint a receiver in the case of Ursula Barnard, prior to the trustees' application to the High Court to sell Cave Court and its contents.

Many of the documents in this subseries were created by or for Long & Gardiner, a London firm of solicitors who acted as agents for Crust, Todd & Mills.
