Case for The Opinion of Counsel for The Hull & Sculcoates Dispensary

Reference No:
C DSS/1/3/2
Dates:
Jun 1908
Description:

Subsequent to the deed of July 1833 there were a further two conveyances dated 1 March 1886 and 30 March 1904 for the purchase of further premises after the sale of St. John's Street, in Baker Street to be wholly used by the Dispensary and in Field Street which was partially used. However, niether of these conveyances or the mortgage deeds was ever enrolled and no trusts or schemes of work were ever formulated by deed. In addition the investments in stocj and mortgages were in many instances in different names.

The Committee were advised that the present position of the investments was unsatisfactory and that a Trust Deed should be prepared declaring the objects of the Institution and vesting the securities in the names of five trustees.

Counsel were asked:

to advise whether the conveyances, mortgages and Declaration of Trust (19 May 1904) should have been enrolled in the Central Office and if so how the omission could be remedied

whether the funds of the Institition were in any way subject to investigation by the Charity Commissioners

In what manner the Trust Deed should be drawn up

Includes a handwritten response (opinion) on the same document.
